By using HiMem, you agree to these terms. They are written to be readable, not to trap you. If something is unclear, email us.
Acceptance
By accessing or using HiMem (himem.ai, the browser extension, CLI, API, or any related service), you agree to be bound by these Terms. If you do not agree, do not use the service.
The service
HiMem provides a persistent memory layer for AI tools. The service includes:
- A cloud API at api.himem.ai for storing and retrieving AI session context
- An MCP endpoint at mcp.himem.ai for AI tool integration
- A browser extension for Chrome, Edge, and compatible browsers
- Progressive web apps
- A command-line interface
We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.
Your account
Access to HiMem requires an API key (hm_live_...). You are responsible for:
- Keeping your API key secure and confidential
- All activity that occurs under your key
- Notifying us immediately if you suspect unauthorized use
You may not share your API key with others unless you are on a Team plan. Team plan keys may be distributed among your authorized team members only.
Acceptable use
You agree not to use HiMem to:
- Store illegal, harmful, or abusive content
- Attempt to access other users' data
- Reverse engineer, scrape, or abuse the API beyond normal use
- Resell or sublicense access to the service without our written permission
- Use the service in any way that violates applicable law
We reserve the right to suspend accounts that violate these terms without refund.
Payment and billing
Paid plans are billed monthly or annually via Stripe. By subscribing you authorize recurring charges to your payment method.
- Subscriptions renew automatically unless cancelled before the renewal date
- No refunds for partial months, except where required by law
- Prices may change with 30 days notice to registered users
- Failed payments result in service suspension after a 7-day grace period
To cancel, email support@himem.ai or manage your subscription via the billing portal.
Your data
You retain full ownership of all data you store in HiMem. We do not claim any rights to your content. See our Privacy Policy for full details on how your data is handled.
You grant us a limited license to store, process, and transmit your data solely for the purpose of providing the service.
Availability and uptime
We aim for high availability but do not guarantee uninterrupted service. HiMem is provided "as is" without warranty of any kind. We are not liable for data loss, downtime, or service interruptions.
We maintain backups but recommend exporting important context via the API or Obsidian export feature regularly.
Intellectual property
HiMem, its code, design, and branding are owned by us. The AE:// protocol specification is developed by Agentir Network and released under open terms — implementors may build compatible clients without restriction.
You may not use the HiMem name, logo, or branding without written permission.
Limitation of liability
To the maximum extent permitted by law, HiMem is not liable for indirect, incidental, special, or consequential damages arising from use of the service, including but not limited to loss of data, loss of revenue, or business interruption.
Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
Termination
You may terminate your account at any time by contacting support@himem.ai. We may terminate accounts that violate these terms.
Upon termination, your data is retained for 30 days before deletion, giving you time to export. After 30 days all data is permanently deleted.
Governing law
These terms are governed by applicable law. Disputes will be resolved through good-faith negotiation first. If unresolved, disputes are subject to binding arbitration.
Changes to these terms
We may update these terms as the product evolves. Material changes will be communicated via email with 14 days notice. Continued use after the effective date constitutes acceptance.
